Data Collection: Sources & Methods

Defensible eDiscovery Under New York Rules
New York’s Commercial Division Rule 11-c governs ESI discovery in Commercial Division cases. It requires that the costs and burdens of ESI discovery be proportionate to the benefits of the case and encourages use of efficient methods, including technology-assisted review, to identify ESI for production. Parties must also confer on ESI topics before the preliminary conference, making early planning both a practical and procedural necessity.
Admissibility carries its own requirements. Under CPLR § 4539, reproductions of business records, including scanned or imaged versions of documents that originally existed on paper, must accurately reflect the originals and, when created through an imaging process, be authenticated to satisfy the best evidence standard. Our documented procedures from collection through production can support that authentication record. Prompt litigation holds and timely collection also address spoliation risk: the negligent or reckless destruction of relevant ESI after a hold is in place can result in court sanctions.
